Damage to property
MCST claims for damages caused by proprietor who cut off wheel clamp
Background: In a heated exchange challenge to an industrial MCST, a dissatisfied proprietor cut off the MCST’s wheel clamp on its illegally parked vehicle.
Challenge: If the MCST fails to enforce against the proprietor, the MCST was worried that other proprietors would similarly disregard bylaws with its industrial estate.
Outcome: Successfully enforced damages against the proprietor on behalf of the MCST with costs, which matter was resolved without hefty legal costs as it was settled quickly out of court.
Workplace Safety and Health Criminal Defence
Supervisor avoids jail time for using a false certificate at work
Background: A supervisor was sent by his company to attend a workplace safety training course close to a decade prior to a piece of work. The supervisor used the certificate from the said course, which was later found to be one that was not recognised by the Ministry of Manpower. Both the company and the supervisor was unaware that the training provider provided sub-standard training and was later discovered to be a certificate mill.
Challenge: Matter was headed to trial for use of a forged certificate (which we argued that the certificate was not forged). The Prosecution amended the charge to one that is for use of a false certificate, which our client pleaded guilty to as the course duration was too short in his experience.
Outcome: The Prosecution submitted for a jail term. We argued that a fine of $4,000 is sufficient. The court decided that the custodial threshold was not crossed in the circumstances and imposed a fine of $5,000.
We managed to secure an outcome that was beneficial to both the client and his company as they did not know with certainty at that time that the training provider was not an accredited one.
Civil dispute
Dog-sitter caught in lovers’ tiff
Background: Client was a mutual friend of a couple who owned a dog. Thinking that the couple was travelling overseas, the client took care of the said pedigree for a few days only to be accused by the boyfriend in the pair of assisting the girlfriend of abducting his dog. The pair had broken up during this time and the girlfriend’s sister delivered the dog to our client for our client’s assistance.
Challenge: The boyfriend demanded the return of the pedigree and an indemnity of any health issues that may have resulted during its time with the client.
Outcome: Advised, attended, and resolved matter with an amicable handover of the pedigree to the legal owner, without need for any payment of damages by the client. Reputation of the good samaritan client was not only restored, but also improved as the handover was made only after a goodwill medical check up at a vet, where the vet stated that there were no health issues.
